If a land owner within Improvement District No. 1 (ID1) files a written application with CVWD for an extension of a distribution lateral pipeline to their lands, they shall adhere to the following process:

A. CVWD shall first determine if it is feasible to construct the lateral extension; then

B. If CVWD staff determine it is found not feasible, the application will be denied by the board of directors; or

C. If the application is found to be feasible and approved by the board of directors, then the lateral shall be constructed by CVWD under the following terms and conditions:

1. Applicant shall deposit 50 percent of estimated construction costs with the district within 15 days after construction. The applicant shall pay the remaining 50 percent of construction.

2. Construction shall include design, construction costs and any right-of-way.

3. No water shall be delivered until the construction costs have been paid in full.

4. In lieu of CVWD constructing the said pipeline, the applicant may secure three bids from local contractors to perform the pipeline construction. The bid shall be presented to the district, who will choose the lowest bid.

5. Upon completion of the pipeline title of the pipeline and easement shall be turned over to CVWD through a bill of sale.

All monies paid for CVWD upon completion CVWD shall pay landowner 50 percent of water tolls and fees on a biannual basis (January and July) for 20 years or until half of the construction cost has been repaid.
