A. Authority to Inspect.

1. Every customer must allow representatives from the district, Regional Water Board, and State Water Board to:

a. Enter upon any premises regulated by a recycled water use permit to make regular and periodic, unannounced inspections of the use site;

b. Have access to and copy, at reasonable times, any records required to be kept this under chapter or any recycled water use permit and have access to any place where records must be kept under the conditions of this chapter;

c. Inspect at reasonable times any facilities, equipment including monitoring and control equipment, practices, or operations regulated or required under a recycled water use permit; and

d. Sample or monitor at reasonable times and while escorted by the customer’s representative for the purpose of assuring compliance with a recycled water use permit or the general order or as otherwise authorized by the California Water Code for any substances or parameters at this location.

2. If an inspector is unable to locate the owner or other persons having charge or control of the premises, or the owner and/or occupant refuses the request for entry, the district may seek assistance from any peace officer or court of competent jurisdiction in obtaining entry.

B. Use Area Monitoring.

1. Each customer must monitor its use areas in accordance with the customer’s recycled use permit and nonpotable water agreement.

2. In order to confirm or ensure compliance with the requirements of this chapter, the district may establish or require the establishment of devices necessary to conduct sampling or monitoring operations on any property.

C. Reporting and Recordkeeping.

1. Each customer must maintain a copy of the recycled water use permit and any applicable nonpotable water agreement available on site for inspection by Regional Water Board staff, state and county officials, and the district.

2. Each customer must implement any monitoring and reporting requirements set forth in the customer’s nonpotable water agreement or in any administrative enforcement action issued to the customer by the district.

3. Each customer must maintain all calibration and maintenance records, monitoring information, reports, and records of data used to complete any application for a recycled water use permit for a period of at least five years from the date of the sample, measurement, report, or application.

4. Any document or report required to be submitted by this chapter must be certified by the customer as follows:

I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to ensure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations.
